The Court of Appeal in Kaduna has affirmed the judgment of Kaduna
State election tribunal by upholding the election of Governor Nasiru
Ahmed El-Rufai as the governor duly elected in the state.
The presiding judge,
Justice I. M. Saulawa while passing judgment on the case, said it lacked merit. He consequently struck out the case.
The Court of Appeal had during its sitting received all relevant
documents filed by all parties involved in the case.
Mr. Polycarp Danladi Gankon had through his legal counsel, Barrister
Olumuyiwa Olowokure, petitioned governor El-Rufai, APC and INEC as
first, second and third respondents respectively.
Mr. Gankon said that the first respondent, El-Rufai was not duly
elected in accordance with the provisions of the electoral act.
He petitioned that the election of the first respondent was voided by
reason of non-compliance with the provisions of the electoral act.
He also requested for an order that will direct the 3rd respondent to conduct a fresh governorship election in Kaduna State in compliance with the provisions of the electoral act.
